Privacy Policy

Effective Date: October 1, 2026

1. Who We Are and What This Policy Covers

Trading with Ashley, LLC, a Louisiana limited liability company (“Trading with Ashley,” “TWA,” “we,” “us,” or “our”), publishes online educational content about options trading and offers courses, programs, events, and a member community. This Privacy Policy explains how we collect, use, share, and protect personal information when you:

  • visit or use tradingwithashley.com, courses.tradingwithashley.com, or any other website, page, form, checkout, or online service that links to this Privacy Policy (together, the “Site”);
  • join our email list, download free materials, register for an event or webinar, request information about a program, or purchase a product or program;
  • participate in our online community (including our Discord server) or use any feature we offer through it, such as our AI assistants, “Ask Ashley AI” and the “TWA Trade Playbook”; or
  • communicate with us by email, text message, telephone, chat, or otherwise.

We refer to all of these together as the “Services.”

If you have enrolled in a Trading with Ashley program, your Program Enrollment Agreement also addresses our information practices. This Privacy Policy is the privacy policy referred to in Article XIV of that Agreement and should be read together with it.

Our Services are intended for adults in the United States. By using the Services, you acknowledge that you have read this Privacy Policy. Where the law requires your consent for a particular use of your information (for example, to send you marketing text messages), we will ask for that consent separately and will not treat your use of the Site as consent.

2. Information We Collect

Information you give us.

  • Contact and identity information: your name, email address, mobile or other telephone number, and, when you provide it, your mailing address.
  • Account information: username, password, Discord username, profile details, and program enrollment details.
  • Payment and transaction information: billing name and address, the product or program purchased, purchase date, price, payment status, and subscription or renewal status. Payments are processed by third-party payment processors, currently Stripe and Whop, which collect and store your payment-card number and related billing details. We do not store full payment-card numbers on our own systems.
  • Communication preferences and consent records: your choices about email, text messages, and telephone calls; the date, time, source, and wording of any consent you give us; and any opt-out request you submit.
  • Communications with us: the content of emails, text messages, chat messages, support requests, survey responses, and, where the law permits (which may require that participants be told a call or session is being recorded), recordings and transcripts of telephone calls, video calls, live group sessions, and chats, including calls and chats conducted by an AI agent on our behalf.
  • Community and program content: posts, messages, questions, and other content you submit in our community, on group sessions, or in our AI assistant channels, together with your program progress and activity.
  • Testimonials and publicity content: reviews and testimonials you provide, and your name, likeness, and voice where you have agreed to let us use them.
  • Information you choose to share about yourself, such as your trading experience or goals, if you volunteer it. Please do not share sensitive information with us or in the community, such as government identification numbers, financial account numbers, passwords, or health information.

Information we collect automatically. When you use the Site, open our emails, or interact with our text messages, we and our service providers automatically collect device and connection data (such as IP address, device and browser type, operating system, language, and referring page) and usage data (such as pages viewed, links clicked, videos watched, time spent, program progress, and whether an email or text message was opened or clicked). We collect some of this information using cookies and similar technologies, described in Section 6.

Information from other sources. We may receive information about you from the platforms and service providers we use to operate the Services (for example, our course platform, checkout and payment providers, and community platform); from advertising platforms that tell us you arrived through an advertisement, or that pass along contact information you submitted to be shared with us; and from social media platforms when you interact with our content there, subject to those platforms’ own privacy policies.

3. How We Use Information

We use personal information to:

  • Provide the Services: create and manage your account, deliver content and programs, process payments and renewals, provide community access, and provide customer support.
  • Communicate with you: send transactional and service messages such as receipts, account and security notices, event reminders, renewal notices, and notices of changes to our terms, and respond to your questions and requests.
  • Market our programs and content: send you information about our programs, events, and content by email, text message, and telephone, in accordance with your choices and applicable law, as described in Sections 4 and 5.
  • Improve and develop the Services: analyze how the Services are used, test features, develop new content, and operate and improve our tools, including our AI assistants and any AI agent that communicates with you on our behalf, as described in the Program Enrollment Agreement.
  • Advertise: measure the performance of our advertising and show you advertisements for our Services on other websites and platforms, as described in Section 6.
  • Protect, enforce, and comply: verify your identity, detect and prevent fraud, abuse, and security incidents, enforce our Terms and agreements, comply with legal obligations, maintain records of consents and transactions, and establish, exercise, or defend legal claims.
  • Publish testimonials and member content: use testimonials, posts, screenshots, and other content you share with us or in our community in our marketing, with your username or your first name and last initial, as described in the Program Enrollment Agreement, and stop using them in new marketing if you ask us to.
  • Fulfill any other purpose that we describe to you when we collect the information, or for which you give consent.

We do not use personal information to make automated decisions that produce legal or similarly significant effects about you.

4. How We Communicate With You, and Your Choices

Email. If you subscribe to our list, download free materials, request information about a program, register for an event, or purchase from us, we may send you educational and promotional emails. Every marketing email we send includes a working unsubscribe link and our postal address. We honor unsubscribe requests within ten business days, and usually much sooner. While you have an account, an active purchase, or a pending request with us, we may continue to send you transactional and relationship messages, such as receipts, account and security notices, and legally required notices, even if you have unsubscribed from marketing email.

Telephone calls. If you give us your telephone number and ask us to contact you (for example, by requesting information about a program or scheduling a call), a member of our team, or an AI agent acting on our behalf, may call you about your request and about our programs. Marketing calls to you made using an automatic telephone dialing system, an artificial or prerecorded voice, or an AI-generated voice require your prior express written consent. You may ask us to stop calling you at any time by telling the person who calls you, by emailing support@tradingwithashley.com, or by any other reasonable method. We maintain an internal do-not-call list, record your request when you make it, honor it within ten business days, and keep it for at least five years.

Text messages. Our text-messaging program is described in Section 5.

How to opt out. You may opt out of marketing communications at any time: click the unsubscribe link in any marketing email; reply STOP to any text message; tell the caller, or email support@tradingwithashley.com, to stop telephone calls; or contact us using the information in Section 16. We may send you one message confirming that you have opted out. Please allow up to ten business days for an opt-out to take full effect across our systems. We keep a record of your opt-out so that we can continue to honor it.

5. Text Message (SMS/MMS) Program Terms and Privacy

Program description. Trading with Ashley sends text messages to people who have opted in to receive them. Messages may include event and training reminders, program updates, account and service notifications, and promotional and marketing messages about our programs, events, and content.

How you opt in. You opt in by checking an unchecked box or otherwise affirmatively agreeing to receive text messages on a web form where you provide your mobile number, by texting a keyword to our number, or by otherwise giving us your express consent. Checking that box is optional: consent to receive marketing text messages is not a condition of purchasing any product or service from us, and you can submit our forms and buy our programs without giving it. If you agree only to account and program notices, we will not send you marketing texts.

Message frequency. Message frequency varies. Messages are recurring.

Costs. Message and data rates may apply. Contact your wireless carrier for details about your plan.

Opting out. Reply STOP to any message to cancel. After you reply STOP, we will send you one final message confirming that you have been unsubscribed, and we will not send you further text messages unless you opt in again. You may also opt out by any other reasonable method, including by emailing support@tradingwithashley.com.

Help. Reply HELP to any message, or email support@tradingwithashley.com, for assistance.

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

Mobile information is not shared for marketing. We do not share, sell, rent, or otherwise provide your mobile telephone number, your text-messaging opt-in data, or your messaging consent information to third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties, except for the aggregators and providers of the text-messaging services we use to deliver our messages, who may use that information only to provide those services to us. Every category of sharing described elsewhere in this Privacy Policy excludes text-messaging originator opt-in data and consent.

6. Cookies, Analytics, and Advertising Technologies

We and our service providers use cookies, pixels, tags, software development kits, and similar technologies (“cookies”) on the Site and in our emails and messages. We use the following categories:

  • Essential cookies, which are necessary to operate the Site, keep you logged in, process checkout, and maintain security.
  • Functional cookies, which remember your preferences and settings.
  • Analytics cookies, which help us understand how visitors use the Site and how our content performs. We use Google Analytics on tradingwithashley.com, the analytics built into our course platform on courses.tradingwithashley.com, and the onsite tracking provided by Klaviyo, our email service provider. Our customer-relationship and messaging platform — currently Close, and GoHighLevel as we move to it — may also set cookies or collect technical information when you use a form, chat widget, or booking page that we run through it.
  • Advertising cookies. We do not currently use advertising cookies, pixels, or tags from social-media or advertising platforms on the Site. If we begin to use them to measure our advertising or to show you advertisements for our Services on other websites and platforms, we will update this Privacy Policy before we do, and you will be able to opt out as described below.
  • Engagement tracking in emails and text messages, which tells us whether a message was delivered, opened, or clicked.

Your choices. You can control cookies through your browser settings, although disabling some cookies may affect how the Site works. You can opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org, and through the advertising settings offered by Google and Meta. Where required by law, we treat a Global Privacy Control (“GPC”) signal sent by your browser as a request to opt out of the sale or sharing of your personal information for targeted advertising on that browser. You may also submit an opt-out request as described in Section 10. Our Site does not respond to browser “Do Not Track” signals, for which no common standard has been adopted.

7. How We Share Information

We share personal information only as described below.

  • Service providers and contractors. We share information with companies that provide services to us, such as website and course-platform hosting, checkout and payment processing, community and chat platforms, our email service provider (currently Klaviyo), our customer-relationship and messaging platform, through which we send text messages and place calls (currently Close, and GoHighLevel as we move to it), scheduling tools, analytics providers, customer-support tools, technology providers we use to operate our AI assistants and AI agents, including providers of voice, transcription, and language-model technology, and our professional advisers. These providers may use personal information only to provide services to us and are required to protect it.
  • Advertising and analytics partners. As described in Section 6, we allow analytics providers, and any advertising platforms we use, to collect information about your use of the Site through cookies so that we can measure our content and advertising. Depending on the state where you live, this may be considered a “sale” or “sharing” of personal information or “targeted advertising.” You can opt out as described in Sections 6 and 10.
  • Affiliates, referral partners, and independent sales representatives. We do not currently operate an affiliate or referral program. If we start one, we will update this Privacy Policy before we share any information with an affiliate or referral partner. Independent sales representatives who work on our behalf may receive your contact information so that they can respond to your request. We do not share text-messaging opt-in data or consent information with any of these parties.
  • Within the community. Information you post in our community, on group sessions, or in our AI assistant channels is visible to other participants.
  • Legal, safety, and enforcement. We may disclose information when we believe in good faith that disclosure is necessary to comply with law, a subpoena, or a lawful request; to enforce our Terms and agreements; to protect the rights, property, or safety of Trading with Ashley, our members, or others; or to detect or prevent fraud or abuse.
  • Business transfers. If Trading with Ashley is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its business or assets, personal information may be transferred as part of that transaction. We will notify you by email or by a prominent notice on the Site of any change in ownership that affects the handling of your personal information.
  • With your consent or at your direction.

We do not sell personal information in exchange for money. We do not share your mobile telephone number, text-messaging opt-in data, or messaging consent information with third parties or affiliates for marketing or promotional purposes.

8. Community, AI Assistants, and Public Content

Our community runs on Discord, a third-party platform whose own terms and privacy policy govern your use of that platform. Anything you post in the community, on group sessions, or in our AI assistant channels can be seen by other participants and should be treated as non-confidential. Messages and questions submitted to our AI assistants may be logged and retained, and may be used to operate, evaluate, and improve those features and our programs as described in the Program Enrollment Agreement. Do not post personal information about yourself or others that you would not want others to see, and never post account numbers, passwords, or other sensitive information. We use testimonials you give us, and posts, screenshots, and other content you share, in our marketing as described in the Program Enrollment Agreement, with your username or your first name and last initial; you may tell us to stop using them in new marketing at any time by emailing support@tradingwithashley.com. Use of a recording of a live session that shows your likeness or includes your voice in advertising outside our programs requires your separate written consent.

9. Data Retention

We keep personal information for as long as needed for the purposes described in this Privacy Policy, which generally means for as long as you have an account or a relationship with us and for a reasonable period afterward to comply with legal, tax, accounting, and record-keeping obligations, to resolve disputes, and to enforce our agreements. We keep records of the consents you give us and of your opt-out requests indefinitely, so that we can show what you agreed to and when, and so that we can continue to honor your choices. When information is no longer needed, we delete it or de-identify it. If you ask us to delete your information or to stop contacting you, we keep only the minimum information needed to honor that request, such as your email address or telephone number, the date of your request, and the channel it applies to, on a suppression list that we check before sending messages.

10. Your Privacy Rights and Choices

Choices available to everyone. Regardless of where you live, you may opt out of marketing communications (Section 4), update your account information by logging in or contacting us, and ask us to delete personal information we hold about you, subject to legal and contractual limits.

State privacy rights. Depending on the state in which you live, you may have the right, under that state’s consumer privacy law, to confirm whether we process your personal information and to access it; to correct inaccurate information; to delete personal information; to obtain a copy of information you provided to us in a portable format; to opt out of targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects; to limit the use of sensitive personal information; and not to be discriminated against for exercising these rights. Whether a particular state law applies to Trading with Ashley depends on that law’s thresholds. To the extent a state privacy law applies to us, you may exercise your rights under it as described in this Section.

How to submit a request. Email support@tradingwithashley.com with the subject line “Privacy Request,” or write to us at the address in Section 16. Tell us which right you want to exercise and the email address or telephone number associated with your account so that we can locate your information. We may ask for additional information to verify your identity before acting on a request, and we will not use that information for any other purpose. You may designate an authorized agent to make a request on your behalf; we may require proof of the agent’s authority and verification of your identity. We will respond within the time required by applicable law, generally within 45 days, and will tell you if we need more time. If we decline a request, we will explain why, and you may appeal by replying to our response or by contacting us at the address in Section 16. If we deny your appeal, you may contact your state attorney general.

Opting out of targeted advertising, “sale,” or “sharing.” To opt out of the use of cookies for targeted advertising, use the tools described in Section 6, enable a GPC signal in your browser, or email support@tradingwithashley.com with the subject line “Do Not Sell or Share My Personal Information.”

Notice to California residents. We collect the following categories of personal information, as defined by the California Consumer Privacy Act: identifiers (such as name, email address, telephone number, IP address, and account name); customer records information (such as billing name and address); commercial information (such as purchase history); internet and electronic network activity (such as browsing and usage data and interactions with our emails and advertisements); approximate geolocation derived from IP address; audio and visual information (such as recorded calls and community sessions, where you have been told they are recorded, and testimonial videos); professional information you volunteer (such as trading experience); inferences drawn from the foregoing; and, as sensitive personal information, your account log-in credentials. We collect this information for the purposes described in Section 3 and keep it for the periods described in Section 9. We do not sell personal information for money, and we do not knowingly sell or share the personal information of consumers under 16 years of age. Our use of advertising cookies may constitute “sharing” for cross-context behavioral advertising, which you can opt out of as described above. We use sensitive personal information only for the purposes permitted by California law, such as maintaining your account and security. California’s “Shine the Light” law (Civil Code section 1798.83) permits California residents to request information about disclosures of personal information to third parties for those parties’ own direct marketing purposes; we do not make such disclosures.

Notice to Nevada residents. We do not sell “covered information” as defined in Nevada law. Nevada residents may nonetheless submit a request to opt out of any future sale by contacting us.

11. Children

The Services are intended for adults and are not directed to anyone under 18. You must be at least 18 years old to use the Services. We do not knowingly collect personal information from anyone under 18, and we do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act. If you believe a person under 18 has provided personal information to us, please contact us and we will delete it.

12. Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for notifying us promptly if you believe your account has been accessed without authorization.

13. United States Only; Visitors From Outside the United States

Our Services are hosted and operated in the United States and are intended for United States residents. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.

14. Third-Party Websites and Services

The Services may link to or integrate with websites and services that we do not control, such as Discord, our course and checkout platforms, payment processors, brokers or tools we mention, and social media platforms. Their privacy practices are governed by their own policies, and we are not responsible for them. We encourage you to read the privacy policy of any site or service you visit.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the revised policy on the Site and update the effective date at the top. If we make a material change in how we use personal information we have already collected, we will notify you by email or by a prominent notice on the Site at least 15 days before the change takes effect, where practicable, and will obtain your consent where the law requires it. Your continued use of the Services after a revised policy takes effect means that you have read it.
